The following General terms and conditions, together with all information relating to your chosen trip/ ceratin travel arrengemts contained on this website or in our relevant printed or digital brochure, form the basis of your Travel Contract with OBT d.o.o. – OutBoxTrip, PE Železnikova 4, 2000 Maribor, Slovenia.
OBT d.o.o. (hereinafter referred to as the Organizer) is selling its own packages under the OutBoxTrip trademark, where it is acting as an Organiser. An integral part of the Travel Contract is also a travel programme or a potential catalogue and pricelist of the Organiser.
Organizer accepts reservations of passengers who agree with these General terms and conditions, which (after a booking and payment) represent the contract concluded between the agency and the passenger.
Please take the time to read and understand the conditions of booking set out below prior to booking a trip with us. We strongly recommend that you also read the Trip Notes relating to your trip or ask us for additional information, prior to booking to ensure that you understand the itinerary, style and physical demands of the trip you are undertaking.
1. GENERAL TERMS AND CONDITIONS
General terms and conditions of travel arrangements are a fundamental part of booking agreement, concluded between Organizer or other accredited agency and passengers, who are booking a certain travel arrangement.
Once the interested passenger orders a certain travel arrangement in the Organizers offices, over the phone or e-mail, or over the partner agency, it is considered that he has accepted the general terms and conditions.
The booking the passenger makes is obligatory and therefore it is possible for the passenger to cancel his booking exclusively according to the general terms and conditions regarding the cancellation of the booking on behalf of the passenger. The passenger is responsible for all the costs and consequences, which may occur due to incorrect information he has provided when making a booking.
2. MAKING A BOOKING AND PAYMENTS
The passenger can book a travel arrangement in the Organizers offices by phone or e-mail, or in any other accredited agency. Daily trips and event tickets can also be booked at selected partner acommodation facilities.
By making a booking Organizer and the passenger agree a travel agreement, which includes the information regarding the travel arrangement that the passenger has chosen or in other cases the travel agreement refers to the travel arrangement program, that consist of all the information regarding the chosen travel arrangement program.
When making a booking, the passenger has to provide all the necessary information and his personal documents that are required by the travel arrangement programs and pay the amount of 30% of the total value of the travel arrangement or he has to follow the instructions, stated in the travel arrangement program.
The passenger has to pay the remaining amount of the travel arrangement price at the latest 30 days before the date of departure or as stated on the booking form / in the travel agreement. If the booking is within 4 weeks of departure then full payment is due.
In case the passenger fails to pay the remaining amount of the travel arrangement price in time, it is considered that he has cancelled his booking and in this case, Organizer follows the regulations of general terms and conditions regarding the cancellation of the travel arrangement on behalf of passenger, as stated in paragraph 4. (Amendment and cancellation of booking on behalf of passenger) of these general terms and conditions.
The booking is not accepted until the date shown on the confirmation invoice is issued by the Organizer.
Payment is possible with bank transfer (bank costs have to be paid by passenger or by partner agency/ touroperator).
3. PRICE OF TRAVEL ARRANGEMENT
Price of travel arrangement is stated in every travel program and becomes valid with the day of the publication of each program. Prices for all the arrangements are given in EUR.
After the invoice has been issued the price is guaranteed against any surcharge, unless an increase is due reasons according to Obligations Code (the changes take place due to changes in currency exchange rates, changes in transport tariffs, changes in fuel price). Should the price changes occur, Organizer has the responsibility to inform the passenger at the latest 20 days before the day of departure.
If the agreed price of the travel arrangement rises more than 10%, it is the right of the passenger to cancel his booking without any further costs, yet it has to be done at the latest 2 days after he has received the notice of the price change.
4. AMENDMENT AND CANCELLATION OF BOOKING ON BEHALF OF PASSENGER
Should you wish to make any changes to your confirmed travel arrangement program, you must notify us in writing as soon as possible. Whilst we will endeavour to assist, we cannot guarantee we will be able to meet any such requests. Where we can, an amendment fee of up to 50,00 € per element altered will be payable together with any costs or charges incurred by us and/or incurred or imposed by any of our suppliers.
The passenger has the right to cancel the booking. The cancellation of booking has to be made in writing. Should this occur Organizer reserves itself the right to claim from the passenger the costs that the agency has suffered due to the cancellation of booking.
The amount of costs depends on the date when the written booking cancellation was received. Unless stated differently in the travel arrangement, the following cancellation terms are to be considered as valid:
Return policy for Organizer tailor made multi day tours:
– In case of cancellation 59-31 days before departure, the cancellation fee is 10% of total price.
– In case of cancellation 30-15 days before departure, the cancellation fee is 40% of total price.
– In case of cancellation 14-8 days before departure, the cancellation fee is 60% of total price.
– In case of cancellation 7-1 days before departure, the cancellation fee is 90% of total price.
– In case of cancellation on the day of departure, the cancellation fee is 100% of total price.
– Non shows will not be refunded.
Return policy for individual travelers for Organizer daily tours:
– Any cancellation up to 72 hours before the trip, is free.
– Any cancellations received later than 72 hours before the departure will be subject to a cancellation fee of 50% of the trip price.
– Cancellation on the day of the departure will be subject to a cancellation fee equivalent to the cost of the trip.
Return policy for event, attraction, show and theater tickets or gift certificates:
– These are non-refundable in all circumstances.
If you leave a trip for any reason after it has commenced we are not obliged to make any refunds for unused services. If you fail to join a tour, join it after departure, or leave it prior to its completion, no refund will be made.
The booking is not accepted until the date shown on the confirmation invoice is issued by the Company. If the booking is not accepted the deposit will be refunded. Alteration or cancellation by a customer of an accepted booking will be subject to the provisions of sections 4 and 5 of these conditions.
5. CANCELLATION OF TRAVEL OR CHANGE OF TRAVEL PROGRAM BY THE AGENCY
The Organizer of the programme may partially or completely cancel the programme if exceptional circumstances which could not have been avoided or prevented arise prior or during its implementation, and which would constitute a justified reason for the organizer not to publish the programme or accept reservations for it if the latter would exist at the time of publication and sale of the package.
The Organizer is responsible to notify the Travellers about the cancellation within a statutory time-limit prior to the commencement of the implementation of the package. In this case, the Organizer shall not be liable for damages to the Traveller, however until the foreseen commencement of the travel he shall be obliged to refund the total amount paid for the package.
Based on the valid legislation, OBT d.o.o. has the right to cancel group programs at the latest 7 (seven) days before the planned date of departure, in case there has not been enough bookings made for the realization of the travel.
Organizer daily tours can be cancelled at the latest the day before the departure of the tour.
The lowest number of passengers is determined with every program individually. Should it happen that the number of passengers does not reach the minimum of passengers needed for the realization of the travel arrangement, the organizer does not take any responsibility for the damage compensation to the passengers, who booked the travel, yet every passenger is reimbursed the full amount of the payment he previously made.
Organizer may replace accommodation agreed upon under the Contract which may also only occur at the location itself, however only with accommodation in the facility of equal or higher category. Any price increase shall not be borne by the passenger.
Due to organizational reasons or weather conditions, the Organizer may change the programme insofar that it is performed in a different order of precedence pursuant to realistic possibilities.
Organizer reserves the right to change the date and time of departure due to the change of the flight schedule or occurrence of force majeure, and the right to change the course of travel if the travel conditions should change (a new timetable, a precarious situation in the country where the programme is organized, natural disasters or other unforeseen causes, which Organizer has no influence over), without special compensation and according to applicable regulations in the passenger traffic.
Organizer shall not be liable for the delay of airplanes, ships or trains as well as not for the programme changes resulting from such delays. The passenger is in these events in relation to the Organizer not entitled to compensation for the unperformed part of the travel programme as well as not to any subsequent price reduction.
Organizer has the right to partially or completely resign from the travel agreement, in case during the duration of the travel or the execution of the program occur unexpected circumstances, which could not have been anticipated, eliminated or avoided, yet for Organizer such circumstances represent a justified cause in which the agency would not have concluded the travel agreement if such circumstances would have existed at the time of its conclusion.
Organizer has the right to partially or completely resign from the travel agreement during the duration of the travel if the passenger does not follow the behaviour rules, which are valid on certain types of transport or in certain accommodation and if the passenger with such behaviour endangers the well-being and health of other passengers and prevents the representative of the agency the realization of the travel program.
6. FORCE MAJEURE
Organizer accepts no responsibility for and shall not be liable in respect of loss or damage or changes caused by forces majeure events such as strikes, riots, political unrest, war hostilities, or threat of war, terrorist activity, industrial disputes, fire, flood, natural or nuclear disaster, weather problems or similar events beyond our control.
7. CATEGORIES OF SERVICES
Unless differently stated in the travel program, the price of the travel arrangement includes all costs of transport, accommodation and meals, as well as the travel organization and travel guide.
As special services are to be considered the costs that are not included into the price of the travel arrangement (single rooms or rooms different to those that are offered in the basic travel arrangements, special meals, additional excursions,…) or the travel arrangement itself lists them as services upon additional payment (visa, airport tax, tourist tax,…). These services are to be paid by the passenger separately. When making a booking, the passenger can express his wishes regarding special services, if they are possible, he will have to provide an additional payment. During the travel the special services have to be paid (in correspondent foreign currency) to the travel guide or to the representative of Organizer wherever these services take place.
The accommodation in programmes are categorised according to the official categorisation, on which the Organizer has no impact. Food, comfort, services and other offers including beaches and swimming pools are under the control of the local tourist organisation and the Organizer has no impact on them. Smaller, insignificant damages to the room paint and builders’ joinery, algae in the gaps of ceramic tiles, slots at the door designed for ventilation and any other slight errors on the room’s equipment which do not have a significant impact on aesthetic view and its functionality irrespective of the category of the facility cannot be a subject of complaint, since they do not reduce the quality of accommodation of guests.
Organizer has the right to inform the passenger about the name of the accommodation upon arrival to the destination.
If the passeneger when making a reservation failed to pay additional charges for a room with special characteristics (ocean view, balcony, equipment, separate beds, location – orientation, specific floor…), he shall accept the accommodation in one of the rooms which are officially registered for issuing to guests in the present hotel. The distribution of rooms is in exclusive jurisdiction of the hotel managers. Organizer has no influence on this, however he can forward passengers’s desires, but he cannot assure that the latter shall be complied with.
With accommodation in a triple-bed room, the passeneger must consider that it is mostly a double-bed room with an extra bed, whereby the accommodation of the third person does not meet the standard of the accommodation of the other two persons. It is usually a folding bed which according to size and comfort does not equal a normal bed and is mostly suited for children.
The Traveller should also consider that a folding bed may significantly limit the movement within the room. Equal warnings apply to double-bed rooms with and an extra bed.
Customarily, the changing of rooms takes place between 12 p.m. and 2 p.m. Therefore it is necessary to leave the room at the date of departure by 10 a.m., since the latter needs to be prepared for new guests. For exact times of assuming and leaving the room, regulations of each individual hotel or apartment house apply.
8. TRAVEL DOCUMENTS
Passengers, who book a trip abroad, must have a valid passport or another suitable document that enables them to enter a foreign country. The passengers who are not residents of the EU must acquire all the necessary documents, required by the countries of the travel destination and the ones they cross when travelling. If the passenger or any of his fellow pessengers who are travelling abroad is not a citizen of one of the Member States of the European Union, he shall be obliged to check the information regarding any potential visas for Slovenia for himself and his fellow passengers at the following link www.mzz.gov.si/en/travel_and_visa_information/ /.
If the Traveller is in any doubt regarding the need to obtain a visa, the Traveller shall be obliged to contact the Organizer by e-mail at the address firstname.lastname@example.org to address this issue before the conclusion of the Contract. If the passenger neglects the above stated activities hereunder, he shall be liable for all costs or consequences incurred to both, him and the Organizer.
The underage passengers need to acquire all the necessary documentation for the border crossing of the underage passengers. Should a passenger not fulfil the obligations given or should it occur that due to the passenger’s unregulated documents he is not able to travel or he has due to the same reasons cancel the travel during its duration, Organizer follows the terms and conditions stated in Return policy.
In case Organizer mediates in the procedure of acquiring a visa for the passenger, the Organizer cannot guarantee that its mediation will be successful. Mediation in the procedure of acquiring visa is not included in the price of travel and needs to be paid separately. The cost of mediation in the procedure is not returned to the passenger in any case.
Should the passenger lose the documents during the duration of the trip or should the documents be stolen and these are necessary for the continuation of travel or for his return to the home country, the passenger has to provide himself new documents on his own costs. In case the passenger has to interrupt the travel due to losing their documents or because they were stolen, he is not entitled to the proportional reimbursement of the paid price of the travel.
9. CUSTOMS AND CURRENCY CONTROL REGULATION
The passenger must respect the customs and currency control regulation of the Republic of Slovenia, as well as of the other countries he is traveling to. Should the passenger due to disrespect of these regulations be unable to continue the travel, the passenger is the only one to suffer the consequences and costs, occurred from such situation.
10. HEALTH REGULATION
According to the regulation of the World Health Organization the passenger is required to get vaccinated before traveling to certain countries, as well as to acquire adequate corresponding documents confirming the vaccination. Vaccination is obligatory even in cases when such health regulation was accepted after the booking was made. Rejection of vaccination is not an excusable reason for the cancellation of booking, unless there are contradictions for the passenger’s health. In such case the passenger has to provide a medical statement.
Organizer is not responsible for eventual complications or the cancellation of the travel on behalf of the passenger which could occur due to disrespect of the health regulation of the country the passenger is traveling to.
The transport of luggage is free up to a certain weight limit, determined by the company that is providing the transportation. Organizer does not take any responsibility for lost or damaged luggage.
The passenger needs to report the lost or damaged luggage to the company that provided the transport or to the accommodation, where the passenger is staying. When travelling by airplane, according to the regulation, valid in the international air passenger traffic, the airline is the one responsible for luggage. In case the luggage got lost, the passenger needs to fill in the form PIR of an airline he was travelling with. Once filled in the form PIR, the passenger needs to hand in one copy of the form to the representative of the airline and retain the other copy for himself. Upon receiving this form the airline reimburses the passenger the compensation of the lost or damaged luggage, according the regulation, valid in the international air passenger traffic.
Organizer is not responsible for the theft or damage of the passenger’s luggage or other personal belongings, valuables and documents in the accommodation, where the passenger is staying (hotels, hotel rooms, apartments, etc.).
Every passenger – holder of the travel agreement, has the right to the reclamation of unsuitable services. According to the regulation of the Consumer Protection Act, the passenger has to inform of all the irregularities and deviations from the agreed and paid travel arrangement to the responsible person for the services (whoever carries them out) or the local representative at the travel destination as soon as possible.
Any verbal notification must be put in writing and given to them as soon as possible. The passeneger proves that a complaint was made at the location with a record which is drawn up with the Organizer’s representative or the tour guide, and material evidence (photographs and similar), which he could have obtained without any special efforts.
Should the passenger fail to do so, after returning home he will not be able to hand in a written complaint, if the deficiencies were not completely settled. The form for the report of the deficiencies is to be received from the representative of the agency at the travel destination.
The passenger has to hand in a written reclamation at least 60 (sixty) days after the conclusion of the travel. In case the passenger misses the legally determined date for the handing in the reclamation, Organizer will not consider his complaint. Without a written reclamation Organizer does not consider the claims for the reduction of the price of travel arrangement or any other types of reimbursements and other claims.
The organizer will not consider a group complaint, which would be signed by more passengers – holders of the travel agreement, resulting from one reclamation claim. To the written claim for the price reduction, reimbursement or other type of claims the passenger needs to attach adequate confirmation of the hotel manager, transport provider or other authorized person, which will confirm the passenger’s claims, on base of which the passenger is demanding the reimbursement (for example, confirmation of payment).
If Organizer holds the responsibility for non-realization of the program or single services, the passenger is entitled to the reimbursement in amount of the real value of the non-realized services or according to applicable regulations of the Consumer Protection Act, except in cases when Organizer has the right to cancel the travel arrangement or change of travel program.
The prices of the travel arrangements, unless differently stated in the program, do not include health insurance, which means that the passengers are responsible for taking care of their own insurance. When travelling abroad it is highly recommended to get the health insurance with global coverage.
14. USE OF DATA
Organizer protects all obtained data on passangers in accordance with the Personal Data Protection Act. It shall be considered that the passeneger by concluding a Contract agrees to the use of these data also for the purposes of statistical processing, sending notifications related to the travel, quality control and informing about Organizer’s offers. By making a booking every passenger gives Organizer his permission to use the photographs and videos made on the travel (the photographs and videos could include every passenger) in promotional and commercial intentions.
If the passeneger does not want this, he may state this when booking a travel, or he may revoke his consent subsequently.
15. FINAL PREMISES
All the prices of Organizers programs include value added tax. Organizer, is not responsible for any information incorrectly given by the selling agent.
Organizer does not take any responsibility for the behaviour of passengers and damage that passengers would cause during the travel. Full payment for any such damage or loss (including lost keys) must be paid direct at the time to the accommodation owner or manager or other supplier. If you fail to do so, you will be responsible for meeting any claims subsequently made against us (together with our own and the other party’s full legal costs) as a result of your actions.
Organizer shall not be liable for any damages, lost profits, injuries, savings, or goodwill resulting from your use or inability to use information provided from this site.
Organizer makes no representation or warranty as to the completeness or accuracy of the information contained in this site.
Organizer reserves the right to change or modify any of the information contained in this Internet site or to the services described therein, without notice but we make no commitment to update such information.
Organizer does not take responsibility for eventual errors in the promotional material (catalogues, leaflets and websites).
For any potential dispute arising from the contractual relationship between the OBT d.o.o. and the passenger which cannot be resolved amicably, the competent court in Maribor shall have jurisdiction over dispute settlement, and the law applied shall be Slovenian.
Organizer reserves the right to update and/or alter these terms and conditions at anytime, and it is the Clients responsibility to be familiar with them.
